Developing of the polices and legislations necessary for the implementation of devolved governments as provided by the constitution of Kenya
The Kenya Government thorough the Deputy Prime Minister and Minister for Local Government is responsible for the implementation of the devolution under the new Constitutional dispensation. To facilitate his office undertake this task he appointed a Task Force on devolved Government (TFDG) on the 22nd of October 2010 initially for 9 months but recently extended by one more month. The task involves study of the Constitution to identify all areas of devolution, study various reports, publications and laws implementing devolution in other countries, consult the public, and benchmark so as to develop the necessary policies and legislations for implementing devolution under the New Constitution of Kenya.
We provided the team leader for the Public Finance Management and Transition Thematic Group responsible for coming up with policies and legislative framework for the implementation of Chapter 12 of the Constitution on Public Finance and Sixth Schedule on Transition of the New Constitution. The output of this task was a Final Report, a public finance management policy and relevant PFM Bills – County Governments Public Financial Management Bill and Intergovernmental Fiscal Relations Bill. In developing the bills and policies on Public Finance, we followed the six critical dimensions identified by PEFA for an open and orderly PFM – budget credibility; budget comprehensiveness and transparency; policy based budgeting; predictability and control in budget execution; adequate accounting, recording and reporting; and that appropriate internal and external scrutiny and audit are in place.
